Claim your unpaid invoice with the letter and interest up to date

If a client doesn't pay, Spanish law entitles you to late-payment interest from the day after the due date and €40 for recovery costs. But since April 2025 you must try to negotiate before going to court and be able to prove it, and if you're not careful you also lose the VAT you paid upfront. Enter the invoice details and we'll give you the exact figure, your timeline and a letter ready to send.

How to claim an unpaid invoice in Spain step by step

What can I claim if a client doesn't pay?

The full invoice, late-payment interest from the day after the due date and a fixed €40 for recovery costs. Interest runs automatically, without you having to give notice or demand payment first (art. 5 of Law 3/2004), and the €40 is always added, without asking (art. 8). If your recovery costs are higher and you can prove them, you can claim them too.

This applies to transactions between companies and freelancers, and between companies and the public administration. It doesn't apply when the client is a private individual (art. 3).

When is an invoice due?

If the contract says nothing, 30 calendar days after delivery of the goods or provision of the service, even if the invoice arrived earlier (art. 4.1). The parties can agree longer, but never more than 60 calendar days (art. 4.3): a 90 or 120-day term isn't valid.

Days are calendar days and holidays can't be excluded from the count (art. 2.d). If there's an acceptance or verification procedure, it can't last more than 30 days.

Why do I have to negotiate before going to court?

Since 3 April 2025, Organic Law 1/2025 requires trying an appropriate dispute resolution method before suing, including for the monitorio procedure (art. 5). If you can't prove it, the court won't admit the claim.

Direct negotiation between the parties counts. To prove it, a document showing the client received your proposal, when, and could read it in full is enough (art. 10.2): that's why it's best sent by burofax with content certification. If they don't reply in writing within 30 calendar days of receiving it, the negotiation ends without agreement and you can claim (art. 10.4). Your request also interrupts the limitation period (art. 7).

How do I claim in court?

Through the monitorio procedure, designed for documented money debts such as an invoice. You don't need a lawyer or court agent to file the claim (art. 814 of the Civil Procedure Act); attach the invoice and proof that you tried to negotiate.

The court requires the debtor to pay or object within 20 days (art. 815). If they do nothing, enforcement follows. If they object, the case goes to trial, and above €2,000 a lawyer and court agent are required.

Can I recover the VAT on an invoice that isn't paid?

Yes. If your turnover last year didn't exceed €6,010,121.04, you can do it once 6 months have passed since the VAT accrued; otherwise, after a year. You must have demanded payment in a verifiable way: a court claim, a notarial demand or any other means that proves it, such as a burofax (art. 80.Four of the VAT Act).

The corrective invoice is issued within the following 6 months and notified to the tax agency within one month of issuing it (art. 24 of the VAT Regulation). Many guides still say 3 months: that was the rule before 2023.

What if the client is a public administration or an individual?

With the public administration there's no need to negotiate before claiming (art. 3.2 of Organic Law 1/2025); the payment term is set by the Public Sector Contracts Act and the claim starts through the administrative route. With a private individual the late-payment law doesn't apply, but you must still try to negotiate before suing.

FAQ

Common questions about unpaid invoices

What is the late-payment interest rate in Spain in 2026?

The statutory rate for commercial transactions is the ECB rate on its last main refinancing operation before the semester plus 8 points, published every semester in the BOE (art. 7 Law 3/2004). In the second half of 2026 it's 10.40%; in the first half it was 10.15%.

When does interest start on an unpaid invoice?

From the day after the due date, automatically and without notifying the client (art. 5 Law 3/2004).

What is the €40 recovery cost?

A fixed compensation added to the debt in every case, without asking or justifying it, when the client pays late (art. 8 Law 3/2004). If your recovery costs are higher and you can prove them, you can claim the difference too.

Is a 90-day payment term legal?

Not between businesses: the agreed term can never exceed 60 calendar days (art. 4.3 Law 3/2004). If the contract sets no term, it's 30 days from delivery or service.

What is MASC and is it required to claim an invoice?

It's the attempt at out-of-court resolution required by Organic Law 1/2025 before suing, including for the monitorio procedure. Direct negotiation with the client counts, as long as you can prove they received your proposal. With no reply in 30 calendar days, you can claim.

Does a burofax count as an attempt to negotiate?

Yes, if it's a genuine invitation to negotiate: a burofax with content certification proves the client received the proposal and what it said (art. 10.2 OL 1/2025). One that only says «pay or I'll sue» is more debatable.

Do I need a lawyer to claim an invoice?

Not to file the monitorio (art. 814 LEC). If the debtor objects and the debt exceeds €2,000, the subsequent trial requires a lawyer and court agent.

How do I recover the VAT on an unpaid invoice?

With a corrective invoice after 6 months (or 1 year, depending on your turnover) from accrual, having demanded payment in a verifiable way, within the following 6 months, and notifying the tax agency within one month (art. 80.Four VAT Act and art. 24 of its Regulation).

Can I claim interest from a public administration?

Yes: Law 3/2004 also applies to transactions between companies and the administration. But the prior negotiation under OL 1/2025 isn't required and the claim follows the administrative route.

Do you store my invoice details?

No. The calculation and the letter are generated in your browser; we don't send or store amounts, names or bank accounts.
