What Spanish law says about how long your lease lasts

How long does a residential lease last in Spain?

Landlord and tenant agree the duration, but if it's under 5 years (7 if the landlord is a company), on expiry the lease is compulsorily extended by yearly periods until it reaches that minimum. This is the mandatory extension in article 9.1 of the Urban Leases Act (LAU).

The extension is only compulsory for the landlord: you can choose not to renew any year by giving 30 days' notice before expiry. If the contract states no duration, it's deemed signed for one year, with the same right to renewal (art. 9.2).

Deadlines count from the contract date or from when the home was handed over to you, if later. If that date is disputed, it's up to you to prove it.

Can I leave before the lease ends?

Yes, once 6 months have passed since the start and with at least 30 days' notice to the landlord. This is the withdrawal right in article 11.1 LAU. Before 6 months you can only leave if the landlord agrees.

For contracts signed from 8 October 2026, leaving this way gives the landlord no right to compensation (art. 11.3, added by Royal Decree-law 29/2026, pending parliamentary validation). For earlier ones, the law allowed a penalty of at most one month's rent per year left to run to be agreed, so it's worth checking your contract.

Can the landlord refuse to renew my lease?

During the 5 (or 7) years they can't end it just because the date in the contract has arrived. There's one exception: if they're a private individual and the contract expressly says they might need the home for themselves or close family, they can take it back after the first year with 2 months' notice (art. 9.3). If they don't move in within 3 months, you can ask to return or claim compensation.

When the 5 (or 7) years are up, the landlord can choose not to renew, but must notify you at least 4 months in advance. If they don't, the lease continues.

What happens when the 5 (or 7) years are up?

If neither side gives notice in time (the landlord 4 months, you 2), the lease is extended year by year for up to 3 more years: the tacit renewal in article 10.1. During those years you can choose not to renew each year with one month's notice; the landlord can't end it earlier.

When it ends, the lease ends. In stressed market areas you can request an extraordinary extension of up to 3 years, and with proven vulnerability, up to 1 year, mandatory if the landlord is a large property owner (art. 10.2 and 10.3).

How do I notify my landlord?

The law refers to notifying or communicating your decision with minimum notice, without setting a specific method. The safe option is to do it in writing so the date and content can be proven: a burofax with content certification, or an email or message the landlord replies to acknowledging it.

Keep the proof: if there's a dispute, you'll have to show you gave enough notice.

FAQ

Common questions about lease deadlines

Does a 1-year rental contract renew automatically in Spain?

Yes. If it's for your main home, on expiry it renews by years until 5 (or 7 if the landlord is a company). The landlord can't stop it; you can choose not to renew with 30 days' notice before expiry (art. 9.1 LAU).

How much notice do I have to give my landlord to move out?

It depends on when. To leave before the lease ends, once 6 months have passed: 30 days (art. 11.1). Not to renew a year within the 5 (or 7): 30 days before expiry (art. 9.1). When the 5 (or 7) years are up: 2 months (art. 10.1). During the tacit renewal: 1 month before each year ends (art. 10.1).

Can I leave before 6 months?

Not on your own: the right to withdraw starts after 6 months (art. 11.1 LAU). Before that you can only leave by agreement with the landlord.

Can the landlord evict me when the contract ends?

Not during the 5 years (7 if a company), even if the contract says less. They could only do so if they're an individual, the contract states they might need the home for themselves or their family and they give 2 months' notice after the first year (art. 9.3), or if you breach the contract, for example by not paying (art. 27). When the 5 (or 7) years are up they can choose not to renew, with 4 months' notice (art. 10.1).

When does the law treat the landlord as a «company»?

When it's a legal entity: a company, a fund or any entity with its own legal personality. Then the minimum duration rises to 7 years. If the owner is one or more natural persons, it's 5 years.

From which date do the deadlines count?

From the contract date or from when the home was made available to you (usually key handover), if later. If it's disputed, you have to prove that date (art. 9.1 LAU).

What happens after 8 years (5 + 3)?

The tacit renewal ends and the lease expires, unless you sign a new one, agree to continue or are entitled to an extraordinary extension for being in a stressed market area or in a vulnerable situation (art. 10.2 and 10.3). With a company landlord it's 10 years (7 + 3).

My contract is from before March 2019. Does this apply?

No. Contracts signed before 6 March 2019 follow the duration rules in force at the time, which were different. The calculator will tell you if your date is earlier.

Does it work for temporary or seasonal lets?

No. Temporary housing leases (for work, studies or a specific reason) have their own maximum duration (art. 9 bis) and different rules for leaving: from one month after signing, with 10 days' notice (art. 11.2). This calculator is for main homes.

Do you store the data I enter?

No. The calculation runs in your browser and the dates aren't sent to any server. Only if you copy the link are your details included in the address itself so you can share it.

The law is the same for everyone. Your contract isn't.
